FUNCTION

The State of California, through the Probate and Welfare and Institutions Codes, authorizes each county to appoint a Public Guardian and Public Administrator to manage the financial and/or personal care needs of an individual who is either physically or mentally unable to provide for their needs and who have no other qualified individual or entity who is willing and able to act.

The Public Adminstrator manages estates of deceased individuals who have no family or qualified executors willing to act. 

The Public Guardian/Administrator works under the direction and in conjunction with the Tehama County Superior Court, Tehama County Counsel and the Social Security Administration.

In California there is a Probate Conservatorship and L.P.S. (Lanterman-Petris-Short) or Mental Health Conservatorship.

The discovery of need is usually made by someone close to the person, such as a family member, physician, neighbor, friend, hospital or other institutional staff member.

Our office also provides a Representative Payee Program substituting as payee for individuals who have difficuly managing money or financial affairs but whose needs can be met without the formality of a conservatorship.
